Asheville Man Gets 120 Days for Shooting Cyclist in the Head

By now just about everyone in Asheville and surrounding communities has heard the story about the Asheville firefighter (Charles Alexander Diez) who shot at a cyclist (Alan Simons) on July 26, 2009. This story has received a ton of media attention both locally and nationally. We don't have anything to add to the story, but since the verdict came down last week the online coverage has been staggering. Check out these popular online websites that have picked up this Asheville news story.

This is downright infuriating. Perhaps you recall this story: while driving down the road one day, Charles Diaz grew upset at seeing a man riding his bike on a busy street with his 3 year-old son. So he shot him in the head. Thankfully, the bullet narrowly missed his skull, instead getting lodged in the cyclists' helmet. Well, Diaz has just been sentenced for admitting to nearly murdering a man by firing a gun towards his head--and he's received a paltry 4 months in jail.
That's right. 120 days. For coming as close to killing someone in cold blood as you possibly can without actually doing so...

Charles Alexander Diez, the former North Carolina firefighter who shot cyclist Alan Simons in the head, has been sentenced to four months in jail.
In an Asheville courtroom last week, Diez pled guilty to shooting Simons during a July 26 roadside confrontation. Said to be upset that Simons was riding his bike with his 3-year-old child, Diez fired his .38 caliber pistol as Simons walked away after the two exchanged words. The bullet struck Simons' bike helmet, narrowly missing his skull.
In August, a grand jury reduced charges against Diez from attempted first degree murder to felony assault. While assault with a deadly weapon with intent to kill certainly sounds like an offense worthy of a lengthy prison term, the presiding judge apparently agreed that this was a case of a stand-up guy having a bad day...

May Diez never know a night alone in jail! I hope his "roommates" show him a real good time! Perhaps that will be a more suited punishment! People go to jail for years because they were smoking a joint... and this mad man gets a measly four months for shooting a man in front of his family?!? This world is totally out of control!
